Regulations

The Marbella Interior Regulations aims to achieve peace and harmony between the condominium owners and inhabitants of Marbella., as well as establishing guidelines regarding its operation and management. 

Below are listed some relevant items referred to in these regulations. Please read and follow these regulations as they are mandatory for all persons in Marbella.

Use of the unit

  • It is the goal of Marbella that all owners and renters enjoy peace and order in their private unit.
  • Do nont carry out activities that could disturb or interfere with the peaceful use and enjoyment of the other owners and renters.
  • It is strictly forbidden to have animalsor pets of any kind within any private unit or common areas of the condominium.
  • Music, television and any other electrical device must be at a moderate volume so as not to disturb others.
  • Parties or meetings within a private unit must be discrete and orderly so as not to disturb others.
  • The maximum capacity of any private unit is limited to two (2) persons for each private unit sleeping area. Each child older than two (2) years constitutes a person. Thus a maximum of six (6) persons older than two years.
  • Clothes or clothes lines are not allowed on the balcony.
  • The following items are not allowed on the balconies: bags, cartons, containers, bicycles, or other similar items.
  • Sandals, dirty clothes, bagged trash, strollers, bicycles, rugs and any other similar object must be stored within the private unit and not in the hallways, building entrances, balconies, or other common areas.
  • Campfires, fire, barbecue grills or gas grills are not allowed on the balconies or in common areas.
  • Trash and waste must be put in the trash bins along the street.
  • Do not install or place signs, notices, or advertising of any kind on the outside of the private unit or in common areas.
  • Do not install electrical or telephone cables or antennas on the outside of the private unit, roof or in common areas.
  • It is the responsibility of each owner to maintain their private unit for cleanliness, maintenance, and repairs. Any maintenance work, painting and repairs within a private unit, including beams, walls, ceiling, floors, accessories and service facilities, are the exclusive responsibility of the owner.
  • Maintenance and repairs within a private unit, involving noise, can only be made during permitted hours: Monday through Friday from 10AM to 2PM and 4PM to 6PM, and Saturdays from 10AM to 2PM. No work is allowed on holidays.
  • Any renovations of a private unit must be authorized in writing by the administrator.
  • Modification to load-bearing walls or exterior appearance of a private unit is strictly prohibited.
  • The owner will ensure the integrity, strength, and security of walls, columns, floors, ceilings, and roofs, and shall immediately advise the administrator of any abnormality of the same.
  • Changes to a private unit that may result in increased consumption of gas, electricity, water, etc. or represent a risk to other owners are not allowed.

Use of common areas

  • Each owner will use the common areas in such a way that it does not adversely affect the use and enjoyment by other owners or occupants.
  • Radios, stereos, and electronic music must be played at a moderate volume so as not to receive a complaint from any owner or occupant.
  • Maintain peace and quiet in the stairwells.
  • Watch your language in the common areas and pool.
  • Wear clothes and footwear suitable for the common areas.
  • Parties or meetings in the common areas are not allowed unless prior approval from the administrator.
  • Owners, occupants and visitors are responsible for the behavior of their children and must ensure that they do not disturb other owners, occupants or visitors or cause damage to the property of other owners or to the common areas.
  • Disturbances, scandals or extreme noise is not allowed in private units or common areas.
  • All domestic employees (housekeepers, service worker, etc.) are considered visitors and must be registered with the administrator or in person at the security gate, by email to condominiosmarbella@hotmail.com, or by calling 322-225-0900. The following information on domestic employees must be provided: name(s), address, date and hours of the required service.
  • Any visitor suspected or caught in the commission of a crime or who have a criminal record, will be banned access to the condominium and, where appropriate, will be submitted to the authority.
  • The condominium is considered private property and shall take all necessary safety precautions to maintain peace, quiet, and order.
  • Please respect the facilities of the condominium: plants, lighting, pool and accessories, road signs and other equipment treat with care.

Use of the swimming pool

  • Pool furniture “cannot be reserved” and are occupied on a first come first use basis. Chairs vacated for more than one hour can be cleared by other guests to use.
  • Marbella pool bracelets must be worn at all times.
  • Glass of any type: bottles, glasses, cups, glass dishes, etc. in our around the pool is strictly prohibited.
  • Children under 12 years old must be supervised by an adult.
  • Coolers, cartons, boxes, and containers in or around the pool area are strictly prohibited.
  • Inflatables or floats in the pool are strictly prohibited.
  • A bathing swimsuit or appropriate pool attire is required at all times.

Use of parking

  • All vehicles entering the condominium are subject to display the appropriate rear-view mirror tag that designates whether the vehicle is an owner, renter, visitor, or worker.
  • Separate color rear-view mirror tags will designate owners, renters, visitors, and workers.
  • Park your vehicle in such a way that it doesn’t use more space than necessary.
  • Make sure no valuables are inside your vehicle and that it is locked and the alarm system is set.
  • During holidays Marbella may restrict access to visitors vehicles.
  • The condominium is not responsible for any damage that may result to owners, renters or visitors, either on your person or your belongings.

Fees

  • Each owner is obliged to pay fees which are ordinary (maintenance) fees, outstanding fees, recovery fees, personal charges and expenses for the maintenance, conservation and repair of condominium areas, goods and common equipment.
  • Maintenace fees made by the owners to the condominium are used to perform the maintenance, upkeep and repair of the condominium and its common areas, as well as the payment of the common expenses.
  • Extraordinary fees are those payments made by the owners for major repairs and improvements to the condominium and its common areas and are not part of regular maintenance fees.
  • Recovery fees are those payments made by the owners for services granted where the condominium is the intermediary, such as maintenance services, extra consumption of electric power such as air conditioning, etc.
  • Personal expenses are the charges made by owners or charges that are attributable to the owner, such as penalties, damages to the condominium and common areas, imposition of sanctions and corrective actions, collection expenses, etc.
  • Maintenance fees are payable by the 10th of each month. After this there is a 10% penalty fee for late payment.
  • If Maintenance fees plus any penalties are not paid after the 20th working day of each month, you will be assessed a penalty equivalent to five (5) minimum wages of the Federal District and the suspension of services.
